Small Claims Court Demand Letter Pack

Three Letter Before Action templates that put a company on formal notice before you ever file a claim.

Most disputes are won on paper, before court

The overwhelming majority of small claims are settled the moment a company realises you are serious. In England and Wales, a "Letter Before Action" is not optional politeness — the pre-action protocol expects you to send one, and judges can penalise a claimant or defendant who ignored it. In the US, a formal demand letter creates a paper trail, starts the clock, and often triggers a settlement offer before you pay a filing fee.

The trouble is that most people either send an angry email that's easy to ignore, or over-complicate a letter until it reads like a threat a company's lawyer can pick apart. A demand letter works when it's calm, specific, and states exactly what happens next.

Step by step

  1. Download the Word document — it contains three letters and a short guide explaining which one fits your dispute.
  2. Pick the letter that matches your situation: a delayed or cancelled flight, a withheld deposit, or an unpaid debt owed to you.
  3. Fill in the fields in [square brackets] with your details, the company's details, the amount owed, and the deadline.
  4. Send it by a method that proves delivery (recorded/certified post or email with a read receipt) and keep a dated copy.
  5. If the deadline passes with no resolution, the letter has already documented that you gave fair warning — you're ready to file with the court.
